§1 General Provisions

These Terms and Conditions define the rules for the sale and delivery of goods by Wonderberry Sp. z o.o., hereinafter referred to as the "Seller."

The Buyer acknowledges that placing an order signifies acceptance of these Terms and Conditions.

These Terms and Conditions apply to all transactions conducted between the Seller and the Buyer unless otherwise agreed in writing by the parties.
§2 Offers and Conclusion of the Contract

All offers made by the Seller, including those presented on the website, are non-binding and subject to change.

The contract is concluded once the Seller confirms the order.
§3 Delivery and Costs

The Seller will deliver the goods to the address specified by the Buyer.

Delivery costs are borne by the Buyer unless otherwise stated.
§4 Complaints and Returns

The Buyer has the right to file a complaint if the goods have defects.

The complaint should be submitted to the Seller within a specified period.
§5 Warranty and Liability

The Seller is liable for defects in the goods sold under warranty.

The Buyer can request repair or replacement of the defective goods.

The right to claim warranty expires after one year from the date of discovering the defect, but not earlier than two years from the date of receipt of the goods.

If the specified warranty period ends after two years from the date of receipt of the goods, the Seller is liable for defects discovered before the end of this period.

In the cases specified in §5 points 15-17, the Buyer may declare withdrawal from the contract or a reduction in price due to a defect in the goods, and if the Buyer requested replacement or repair, the time limit for declaring withdrawal or reduction starts after the unsuccessful expiration of the replacement or repair period.

In the event of pursuing one of the warranty rights before a court or arbitration court, the deadline for exercising other warranty rights is suspended until the court proceedings are finally concluded. This also applies to mediation proceedings, where the deadline for exercising other warranty rights starts from the day the court refuses to approve the settlement reached before the mediator or the unsuccessful completion of mediation.

The rights under the warranty for legal defects of the goods are governed by §5 points 15-16, except that the deadline starts from the day the Buyer learned about the defect, and if the Buyer learned about the defect only as a result of a lawsuit by a third party, from the day the judgment in the dispute with the third party became final.

If the Buyer has declared withdrawal from the contract or a reduction in price due to a defect in the goods, they may claim compensation for the damage suffered due to entering into the contract without knowing about the defect, even if the damage resulted from circumstances for which the Seller is not liable. This includes claiming the return of contract conclusion costs, costs of receipt, transport, storage, and insurance of the goods, and costs of damage to the goods resulting from the defect.
§6 Complaints Procedure and Return of Goods

The Buyer has the right to return the goods within 14 days from the date of receipt without providing a reason.

The returned goods must be in their original packaging, unused, and in a condition allowing for resale.

The Seller will refund the payment within 14 days from the date of receipt of the returned goods.

The cost of returning the goods is borne by the Buyer.
§7 Final Provisions

In matters not covered by these Terms and Conditions, the relevant provisions of Polish law shall apply.

The Seller informs that the Buyer has the right to use extrajudicial means of pursuing claims and obtaining a solution to disputes. Information on the extrajudicial dispute resolution methods can be obtained on the ODR platform or by selecting any entity authorized from the UOKiK register. The Seller declares the intention and agrees to resolve the consumer dispute out of court.

In the final instance, the matter is resolved by the court having local and subject matter jurisdiction.
